Bombay High Court Convicts Former Tehelka Editor Tarun Tejpal in 2013 Rape Case; Sentences Him to 10 Years

PANJIM, GOA — In a landmark verdict delivered on Thursday, August 6, 2026, the Bombay High Court (Goa Bench) overturned a 2021 trial court acquittal and sentenced former Tehelka magazine editor-in-chief Tarun Tejpal to 10 years of rigorous imprisonment for the rape of a junior colleague in 2013.

A division bench comprising Justices Neela Gokhale and Amit Jamsandekar found Tejpal, 62, guilty under multiple sections of the Indian Penal Code (IPC), including Section 376(2)(f) (rape by a person in a position of trust or authority), Section 354A (sexual harassment), and Section 354B (assault with intent to disrobe).

“Perverse” Acquittal Overturned

The High Court’s ruling comes five years after a Goa sessions court had acquitted Tejpal of all charges in May 2021, a decision that sparked national outrage. The High Court bench harshly criticized the trial court’s original judgment, labeling its reasoning as “perverse” and fundamentally flawed.

“The trial court’s evaluation of the victim’s testimony exhibited multiple fatal flaws, largely stemming from preconceived notions and reliance on how an ‘ideal’ victim should physically resist or emotionally react,” the bench noted in its order. The judges emphasized that the prosecution had successfully established the case beyond reasonable doubt, adding that the survivor’s truthful account had been undermined by the lower court’s stereotypical assumptions.

Arguments on Sentencing

During the hearing on the quantum of sentence, the courtroom saw a stark clash of legal arguments:

  • The Prosecution: Representing the Goa government, Solicitor General Tushar Mehta urged the court to impose the maximum possible sentence. He argued that Tejpal, who acted as a “father figure” and employer to the victim, had committed a grave breach of trust. “His attitude was extremely brazen,” Mehta stated, calling on the court to send a strong message that “no means no,” regardless of the accused’s status.
  • The Defence: Senior advocate Abad Ponda, appearing for Tejpal, pleaded for leniency. He highlighted that this was Tejpal’s first offense and noted his age, family responsibilities, and his compliance with all bail conditions since the trial began.

Tejpal personally addressed the bench, claiming he was a “political victim” and stating, “For the last 13 years, we have been working to bring facts and truth to light. Obviously, that holds no significance today”.

Case Background and Next Steps

The incident occurred in November 2013 inside the elevator of a luxury hotel in Goa during the THiNK festival, an event hosted by Tehelka. The survivor alleged that Tejpal sexually assaulted her on two consecutive days.

The court imposed a total fine of ₹10,21,000, which is to be paid to the survivor. While the court initially granted a two-week window for surrender, it later extended the deadline to four weeks to allow Tejpal time to file an appeal in the Supreme Court. Speaking to reporters outside the court, Tejpal reiterated his intent to challenge the conviction, asserting, “We feel the order is wrong”.

Investigating Officer Sunita Sawant, who led the case, hailed the verdict as a victory for workplace safety, stating, “This is a sentence where a girl has stood up for her rights… this judgment is very important for women working in any sector”.
